This translation is provided for convenience. Only the German version is legally binding.
Terms of use for the VOXPEERS app, subscriptions, minute packs and VOXPEERS Tourist.
1.1 These Terms and Conditions apply to the use of the VOXPEERS app (group intercom and navigation) and the voxpeers.com website, including the account and tour portal. The provider is:
VOXPEERS, Inhaber Norbert Mächler, Schönaustrasse 2b, 8722 Kaltbrunn, Switzerland — hereinafter “we”.
1.2 The version published at the time the contract is concluded shall apply. Deviating terms of users shall not apply.
1.3 The offering is aimed at users in Switzerland, Germany, Austria and Liechtenstein. Minimum age: 16 years; younger persons may use VOXPEERS only with the consent of their parents or legal guardians.
2.1 VOXPEERS offers:
2.2 The app requires an internet-enabled device (iOS/Android), a data connection and, for navigation/intercom, the location and microphone permissions respectively. You bear any mobile data costs yourself.
2.3 We continuously develop VOXPEERS and may change or add functions, provided that the core benefit (intercom + navigation) is preserved. We will inform you of material changes in good time.
3.1 Use requires an account with a valid email address. You must keep your login details secret; actions carried out via your account are attributed to you to the extent that you are responsible for them.
3.2 One account per person; passing on or selling accounts is prohibited. Company accounts under section 4.4 are an exception to this, insofar as several personal guide accounts are combined there under a shared company credit balance; each member remains responsible for their own account (section 3.1).
4.1 Start offer (one-off): Getting started costs CHF 4.50 (one-off) and comprises access limited to 30 days, which includes 300 intercom minutes, full navigation including tour features, and 5 listener hours for VOXPEERS Tourist to try out. All components are part of this time-limited access: when the 30 days expire, the access ends; unused Start minutes and unused Start listener hours therefore lapse. The Start offer is accordingly not a credit block within the meaning of sections 4.3 and 4.4 — minute blocks and listener-hour blocks purchased later do not expire. There is no permanently free version.
4.2 Subscriptions: After the Start offer, the following subscriptions are available (prices in CHF; in EUR, the prices shown in the respective store apply):
| Subscription | Monthly | Annual | Included |
|---|---|---|---|
| Pro | 4.90 | 49.– | monthly minute allowance + full navigation, groups of up to 20 listeners |
| Mega | 9.90 | 99.– | larger minute allowance + full navigation, groups of up to 50 listeners |
VOXPEERS Tourist is not a subscription. It is billed exclusively via prepaid listener-hour blocks; the listener minutes actually used are deducted. For details, see section 4.4.
4.3 Minute blocks: Additional intercom minutes are available as one-off purchases at CHF 2.90 / 4.90 / 9.90. Purchased extra minutes are valid without time limit and do not expire; they carry over across changes of month and device as well as a change of subscription. They are added to a shared extra-minutes balance and are only used once the subscription’s monthly allowance has been used up. Unlimited validity presupposes an existing account: if the account is deleted (section 11), we will draw your attention to any remaining balance during the grace period; upon final deletion of the account, the remaining balance is extinguished.
4.4 VOXPEERS Tourist — payment exclusively via prepaid credit: VOXPEERS Tourist is not sold as a subscription. Guides or company accounts (see below) purchase exclusively prepaid credit in listener hours as a store consumable: 45 listener hours = CHF 25.–, 100 listener hours = CHF 54.–, 400 listener hours = CHF 192.–, 1’200 listener hours = CHF 500.–. No other block sizes are available; individual purchase per listener or per tour is not possible. These prices are non-binding information (section 4.5).
4.5 All prices stated in this section 4 (subscriptions, minute blocks, VOXPEERS Tourist listener-hour blocks) are non-binding information without legal effect; they serve as a guide. The only authoritative price is the price displayed in local currency in the respective store (Apple App Store or Google Play) at the time of purchase. All prices include any applicable VAT. Price changes apply only to the future and will be announced before they take effect; for subscriptions, they apply at the earliest from the next renewal period.
5.1 Purchases and subscriptions are processed via the Apple App Store or Google Play. The purchase contract regarding payment processing is concluded in accordance with the rules of the respective platform; their terms apply in addition.
5.2 Subscriptions renew automatically for the selected period (month/year) unless they are cancelled no later than 24 hours before expiry via the subscription management of the respective store. Cancellation is made directly with Apple/Google (store account → Subscriptions); cancellation vis-à-vis us is not sufficient to stop payments.
5.3 After a subscription expires, your account, tours, unused extra minutes (section 4.3) and unused listener-hour credit (section 4.4) are retained; subscription features (intercom allowance, full navigation) are restricted until a new subscription is taken out.
5.4 We may terminate the contract by giving 30 days’ ordinary notice to the end of the current subscription period; services already paid for but not yet provided will be refunded pro rata. The right to extraordinary termination in the event of serious breaches (section 7) remains reserved.
6.1 Consumers resident in the EU/EEA generally have a 14-day right of withdrawal when purchasing digital content/services.
6.2 Expiry in the case of immediate provision: If, when making the purchase, you expressly agree that we may begin performance before the withdrawal period expires and you acknowledge that you thereby lose your right of withdrawal, the right of withdrawal expires upon complete provision (for digital content) or, for services, continues to exist only pro rata until complete performance.
6.3 For purchases via the Apple App Store or Google Play, the practical handling of withdrawal and refunds follows the process of the respective platform (Apple or Google is your point of contact for reversing the payment). For digital content that is not supplied on a tangible medium (e.g. minute and listener-hour blocks, unlocks), the right of withdrawal expires once we have begun providing it, after you have expressly agreed during the purchase process that we begin providing it immediately and have confirmed that you thereby lose your right of withdrawal (Art. 16(m) of Directive 2011/83/EU and Section 356(5) of the German Civil Code respectively).
6.4 Model withdrawal information and form: see the annex at the end of these Terms and Conditions.
6.5 Consumers resident in Switzerland have no statutory right of withdrawal; the goodwill/refund processes of the stores remain unaffected.
7.1 Safety comes first: VOXPEERS is designed for hands-free use. You alone are responsible for your conduct in road traffic. Do not operate the app by hand while riding, observe local regulations on headphones in traffic and always remain attentive to ambient sounds. Navigation instructions do not relieve you of the need to exercise your own caution; do not follow any route contrary to road signs or traffic conditions.
7.2 The following are prohibited in particular: unlawful, offensive or harassing content in the intercom or tour portal; interference with the technical infrastructure; automated data extraction; passing on login details; use for the purpose of monitoring third parties without their knowledge. We have zero tolerance for objectionable content and abusive users. In group radio you can report and block other members at any time; admins can remove and ban members. We review reports within 24 hours and, in the event of a breach, remove the content concerned and/or exclude the person responsible.
7.3 In the event of breaches, we may remove content, block functions or terminate the account for cause; in the event of serious breaches, we reserve the right to claim damages.
8.1 Your own tours are initially private. If you submit a tour for publication, we review it editorially and approve or reject it.
8.2 You warrant that you hold the necessary rights to the content submitted (tracks, descriptions, photos). For approved tours, you grant us a simple, free-of-charge right of use to display and distribute them in the VOXPEERS portal and in the app; your copyright remains with you. You can end publication at any time (withdraw the tour).
8.3 Published tours are accounts of other users’ experiences; we accept no liability for the passability, condition or legal permissibility of the routes.
9.1 We strive for high availability but do not owe uninterrupted accessibility. Intercom and navigation depend on the mobile network, GPS reception and third-party services (including map, routing and audio infrastructure); dead spots and third-party outages are beyond our control. Where possible, we announce maintenance windows in advance.
9.2 Map, elevation and routing data come from third-party sources (including OpenStreetMap) and may be incomplete or out of date.
9.3 The statutory warranty rights apply, in particular the mandatory consumer rights for digital products at the consumer’s place of residence (obligation to provide updates, rights in respect of defects).
10.1 We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under mandatory statutory liability provisions (e.g. product liability).
10.2 In the case of slight negligence, we are liable — to the extent permitted by law — only for breach of material contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may rely), limited to the foreseeable damage typical for the contract.
10.3 Otherwise, liability is excluded to the extent permitted by law. Mandatory consumer law of your country of residence remains unaffected.
Information on the processing of your data can be found in our Privacy Policy. Account deletion: You can mark your account for deletion at any time at voxpeers.com/konto. A 30-day grace period then applies; during this period you can cancel the deletion at any time and your account remains unchanged. If the deletion is not cancelled, the account is permanently deleted once the period has expired.
We may amend these Terms and Conditions if this is necessary for legal, technical or economic reasons and does not unreasonably disadvantage you. We will announce changes at least 30 days before they take effect, in the app or by email. If you do not object before they take effect, the new Terms and Conditions apply; we will point out this consequence in the announcement. If you object, you may terminate the contractual relationship with effect from the end of the current subscription period.
13.1 Applicable law: Swiss law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules. If you are a consumer habitually resident in the EU/EEA, the mandatory consumer protection provisions of your country of residence remain unaffected.
13.2 Place of jurisdiction: To the extent permitted by law, the place of jurisdiction is Kaltbrunn, Canton of St. Gallen, Switzerland. Mandatory places of jurisdiction for consumers remain reserved.
13.3 Should individual provisions be invalid, the remainder shall remain valid; the invalid provision shall be replaced by the statutory provision.
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (VOXPEERS, Inhaber Norbert Mächler, Schönaustrasse 2b, 8722 Kaltbrunn, Switzerland, email: info@voxpeers.com) of your decision to withdraw from this contract by means of a clear statement (e.g. email). You may use the attached model withdrawal form for this purpose, but this is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event no later than fourteen days from the day on which we receive your notice of withdrawal. We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise. If you requested that the service begin during the withdrawal period, you shall pay us an amount proportionate to the services already provided up to the time of withdrawal.
Expiry: In the case of contracts for the supply of digital content not supplied on a tangible medium, the right of withdrawal expires if we have begun performance after you have expressly consented to our beginning before the end of the withdrawal period and you have acknowledged that by giving your consent you lose your right of withdrawal once performance has begun.
